GENERAL TERMS AND CONDITIONS OF DELIVERY AT VALK MOTORPARTS
1. Relevance1.1 These general terms and conditions of delivery apply to all articles ordered from Valk Motorparts in writing or through electronic orders. By placing an order clients indicate that they agree to these general terms and conditions of delivery.
1.2 Valk Motorparts maintain the right to refuse an order placed due to special circumstances. A message to this effect will be forwarded to the client within a period of 10 working days after the order has been placed.
1.3 Valk Motorparts maintain the right to amend or add to the general terms and conditions from time to time.
2. Prices
2.1 Prices given in flyers, brochures, magazines, internet pages, advertisements, etc. are in Euros and inclusive of VAT, but exclusive of postage and packaging.
2.2 Costs involved with postage and packaging are given on the website of Valk Motorparts. The level of costs for postage and packaging depends on the weight and format of the article, as well as the destination within the Netherlands, Europe or beyond.
2.3. All offers are without obligation and Valk Motorparts maintain the explicit right to amend prices, specifically if such is required on the grounds of legal requirements.
3. Payment
3.1 The client may choose from the following payment methods:
- Bank or Giro transfer
- Credit card
- iDEAL
Any other payment options available are listed on the shop site of Valk Motorparts.
3.2 The customer will not be charged for using his credit card.
3.3 The cardholder will be debited directly after he or she made the purchase.
3.4 The customer receives an affirmation right after making his order by email. The customer needs to save this email as a proof of his order. The customer receives his invoice by email together with the shipping confirmation by email.
3.5 Orders are sent out as soon as payment is received by Valk Motorparts. This in effect means that only articles that have been paid for are delivered by Valk Motorparts.
3.6 We make use of a secure payment page which has been offered to us by our Payment Service Provider Chronopay. This payment page is secured via a SSL certificate.
3.7 On the credit card statement of the customer a purchase made on our website will be shown as: chrpay.com/www.valkmotorparts.com.
4. Delivery
4.1 Valk Motorparts maintain the right to deliver orders in parts.
4.2 Delivery takes place through TNT postal services to the address supplied by the client.
4.3 Valk Motorparts is responsible for the safe delivery of the product. This responsibility towards the product is transferred to the client upon delivery.
4.4 Delivery within the Netherlands normally takes place within five working days after an order has been confirmed. This term could vary between four to ten days, however, depending on the speed of the method of payment chosen.
4.5 Provide for an additional delivery period of approximately five working days for other countries within Europe and an additional ten working days for countries beyond Europe.
4.6 The delivery periods stated are only guidelines. Should these periods be exceeded the client does not have any right to claim compensation, nor does he/she have the right to cancel the order or the agreement, unless the delay in delivery is of such a period of time that the client cannot reasonably be expected to honour the agreement. The client would in such an event be entitled to cancel the agreement should such be deemed necessary.
4.7 If an article has been ordered and paid for that is not currently in stock, Valk Motorparts maintain the right to offer a comparable article to the client. If the client should not agree with this, Valk Motorparts will refund the amount paid to the bank account supplied by the client.
5. Complaints
5.1 It is the duty of the client to check if the article satisfies requirements upon receipt. If this is not the case the article can be returned to Valk Motorparts free-of-charge within a period of six working days. Valk Motorparts is then required to send the client a replacement copy.
5.2 Should the client wish to return a product that satisfies requirements, the product can be returned to Valk Motorparts within a period of seven working days. Such a return would only be accepted if the product and its packaging are undamaged. Costs involved with returning the product are payable by the client. Valk Motorparts will return the cost of the article, excluding postage and packaging to the bank account as provided by the client. Products that have been custom-produced for the client cannot be returned under such circumstances.
5.3 We react to all customer queries within two working days.
6. Assembly
Valk Motorparts can under no circumstances be held liable for the consequences of an article sold by them that had been improperly mounted.
7. Miscellaneous
Should Valk Motorparts decide to apply the general sales terms and conditions in a flexible manner, their rights to strictly apply these terms and conditions would remain intact.
8. Force Majeur
8.1 In the event of force majeur Valk Motorparts maintains the right to cancel an order or to cancel an agreement without legal intervention being required, without prejudice to any of their accrued rights. This must be done by informing the client of such in writing. Valk Motorparts cannot be held liable for damages incurred in such an event, unless the given circumstances are reasonably and fairly considered to be inappropriate.
8.2 Force majeure is understood to be any shortcomings beyond the control of Valk Motorparts for which they cannot be directly held responsible in terms of the law or legal actions or with the interpretation of current transactions.
